Temporary Visas

 One of the main issues involving temporary visas is the discretion of the immigration officer who conducts the interview with the applicant.  This officer has unrestricted discretion to make a decision on each applicant.  There is no appeal process from his/her decision.  Further, if the visa application is rejected, the passport is stamped on the back indicating that the applicant has been rejected for a visitors’ visa, thereby effectively resulting in the inability to ever receive a US visa again.

 We would welcome the opportunity to assist people with obtaining this type of visa.  Due to the above mentioned issues and the risk of getting rejected, it would be well advised for our firm to become involved at the beginning of the process prior to anyone experiencing a rejection or even making an application.

 We review all materials as if we were the immigration officer, make recommendations as to how the written presentation needs to me made or modified (particularly the financial information and family members remaining in the country of origin) and based on the client’s background, we recommend how to approach the immigration officer during the interview process to ensure the best interview possible.  We could easily place all recommendations in the form of a memorandum to you and your colleagues so that it will be presented to the client properly. 

 Additionally, we are often called upon to become attorney of record for temporary via applicants.  In this case, we submit the application, correspond on our letterhead, customize an interview technique for the applicant and speak directly to the immigration officer.
